Cette soci\u00e9t\u00e9 sollicite de la Cour, l\u2019annulation dans toutes ses dispositions, du jugement rendu en date du 19 d\u00e9cembre 2023 par le Tribunal du Travail de Kinshasa\/Gombe.<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Rappel des faits<\/h4>\n\n\n\n<p>Suite \u00e0 la d\u00e9couverte des pi\u00e8ces comptables faisant suspecter le d\u00e9tournement des fonds au d\u00e9partement juridique dirig\u00e9 par Jean-Pierre Ntumba Kabesa, l\u2019employeur de ce dernier (MIDEMA) a ouvert une enqu\u00eate en janvier 2022. Mis au parfum de cette enqu\u00eate, le concern\u00e9 <em>\u00ab&nbsp;fit une fuite en avant&nbsp;\u00bb<\/em> en adressant \u00e0 son employeur <em>\u00ab&nbsp;une demande de s\u00e9paration \u00e0 l\u2019amiable&nbsp;\u00bb <\/em>et ce,<em> \u00ab&nbsp;sans pr\u00e9avis&nbsp;\u00bb<\/em> dans l\u2019unique but <em>\u00ab&nbsp;d\u2019obstruer l\u2019enqu\u00eate ainsi diligent\u00e9e&nbsp;\u00bb<\/em> apprend-t-on des sources proches du dossier.<\/p>\n\n\n\n<p>Ayant constat\u00e9 l\u2019abandon de poste, MIDEMA adressa \u00e0 son Conseiller Juridique une demande d\u2019explications. En date du 05 mai 2022, Jean-Pierre Ntumba Kabesa r\u00e9pondit \u00e0 la demande d\u2019explications lui adress\u00e9e et, \u00e0 la m\u00eame date, d\u00e9cida <em>\u00ab&nbsp;unilat\u00e9ralement de notifier&nbsp;\u00bb<\/em> \u00e0 son employeur, la fin de ses prestations pr\u00e9textant ce dernier aurait commis <em>\u00ab&nbsp;une faute lourde&nbsp;\u00bb<\/em> pour n\u2019avoir pas encore r\u00e9pondu favorablement \u00e0 sa demande de s\u00e9paration \u00e0 l\u2019amiable alors qu\u2019il ressort des documents en notre possession que la soci\u00e9t\u00e9 n\u2019a commis aucune faute ayant justifi\u00e9 cette rupture unilat\u00e9rale du contrat de travail.<\/p>\n\n\n\n<p>Quatre jours apr\u00e8s avoir r\u00e9sili\u00e9 son contrat de travail et confectionn\u00e9 lui-m\u00eame un document intitul\u00e9 <em>\u00ab&nbsp;d\u00e9compte final comment\u00e9&nbsp;\u00bb<\/em>, Jean-Pierre Ntumba Kabesa s\u2019est permis n\u00e9anmoins d\u2019attraire MIDEMA en justice.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Une d\u00e9cision judicaire contestable<\/h4>\n\n\n\n<p>Le Tribunal de Travail de Kinshasa\/Gombe qui a \u00e9t\u00e9 saisi pour trancher ce litige, a d\u00e9clar\u00e9 fond\u00e9e&nbsp;l\u2019action originaire et a condamn\u00e9 l\u2019employeur pour <em>\u00ab&nbsp;faute lourde&nbsp;\u00bb<\/em> estimant que ce dernier a \u00ab&nbsp;d\u00e9lib\u00e9r\u00e9ment&nbsp;\u00bb refus\u00e9 de se conformer aux dispositions pertinentes de l\u2019article 61 bis du Code du Travail.<\/p>\n\n\n\n<p>Le Tribunal a cependant condamn\u00e9 MIDEMA au paiement des dommages au profit de Jean-Pierre Ntumba Kabesa de l\u2019ordre de 131.852,56 USD repr\u00e9sentant 28 mois de sa derni\u00e8re r\u00e9mun\u00e9ration. Il lui a par ailleurs condamn\u00e9 au paiement de la somme de 742.414,71$US&nbsp; \u00e0 titre de d\u00e9compte final.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">D\u00e9monter l\u2019\u0153uvre du Premier juge au degr\u00e9 d\u2019appel<\/h4>\n\n\n\n<p>Contre ce jugement, la Soci\u00e9t\u00e9 MIDEMA a interjet\u00e9 appel sollicitant son annulation. Pour convaincre le juge d\u2019Appel, elle a soulev\u00e9 trois moyens d\u00e9montant ainsi l\u2019\u0153uvre du premier juge&nbsp;; ces moyens sont notamment, Primo, celui tir\u00e9 de la violation des articles 21 de la Constitution et 23 du Code de Proc\u00e9dure Civile portant obligation \u00e0 tout juge de motiver sa d\u00e9cision&nbsp;; secundo, celui fond\u00e9 sur la mauvaise interpr\u00e9tation de l\u2019article 61 bis&nbsp; du Code du Travail en combinaison avec l\u2019article 33, alin\u00e9a 2 du Code Civil Congolais, Livre III en ce que le premier juge \u00e9rige en faute lourde le droit de chaque partie au contrat de travail d\u2019user de sa libert\u00e9 de conclure un accord mettant fin au contrat de travail; et tertio, celui tir\u00e9 de l\u2019application erron\u00e9e de l\u2019article 73, point e du Code du Travail en ce que le d\u00e9faut d\u2019accepter une demande de r\u00e9siliation du contrat de travail de commun accord des parties ne constitue pas un manquement grave aux obligations du contrat et permettant au travailleur de r\u00e9silier le contrat pour faute lourde de l\u2019employeur.<\/p>\n\n\n\n<p>Se faisant, MIDEMA a fait observer au juge d\u2019appel, en ce qui concerne le deuxi\u00e8me moyen que, <em>\u00ab&nbsp;le l\u00e9gislateur n\u2019a impos\u00e9 aucune obligation ni d\u00e9lai \u00e0 l\u2019employeur pour acc\u00e9der \u00e0 la demande de r\u00e9siliation du contrat de travail de commun accord des parties&nbsp;\u00bb<\/em>. Elle fait observer en outre que le premier juge a mal interpr\u00e9t\u00e9 l\u2019article 61 bis du Code de Travail&nbsp;car <em>\u00ab&nbsp;l\u2019accord vis\u00e9 par ce texte \u00e9tant un v\u00e9ritable contrat soumis aux r\u00e8gles de la libert\u00e9 contractuelle consacr\u00e9e par les dispositions des articles 8 et suivants du Code Civil Congolais, Livre III&nbsp;\u00bb.<\/em><\/p>\n\n\n\n<p>Manquer gravement aux obligations du contrat renvoie au&nbsp; non-respect des obligations pour l\u2019employeur de fournir \u00e0 son employ\u00e9 l\u2019emploi convenu et lui payer convenablement la r\u00e9mun\u00e9ration de ses prestations. Alors le l\u00e9gislateur de l\u2019article 73C du Code du Travail ne permet au travailleur de r\u00e9silier le contrat de travail pour faute lourde de l\u2019employeur que lorsque celui-ci manque gravement aux obligations du contrat, notamment lorsqu\u2019il persiste \u00e0 ne pas appliquer les dispositions l\u00e9gales ou r\u00e9glementaires en mati\u00e8re du travail. MIDEMA estime que le premier juge n\u2019a nullement d\u00e9montr\u00e9 dans son jugement en quoi elle <em>\u00ab&nbsp;aurait manqu\u00e9 gravement \u00e0 ses obligations contractuelles sus-rappel\u00e9es&nbsp;\u00bb.<\/em><\/p>\n\n\n\n<p>Invoquant le point e de l\u2019article 73 du Code du Travail visant le cas o\u00f9 l&#8217;employeur persiste \u00e0 ne pas appliquer les dispositions l\u00e9gales ou r\u00e9glementaires en vigueur en mati\u00e8re du travail et 61 bis pr\u00e9voyant la facult\u00e9 qu&rsquo;ont les parties \u00e0 r\u00e9silier le contrat de travail de leur commun accord, MIDEMA soutient que \u00ab&nbsp;<em>le premier juge a confondu cette facult\u00e9 qui est un droit reconnu \u00e0 chaque partie \u00e0 l\u2019obligation de conclure l&rsquo;accord vant\u00e9&nbsp;\u00bb<\/em>.<\/p>\n\n\n\n<p>Ainsi dit, cette soci\u00e9t\u00e9 \u00e0 travers ses conseils a pu d\u00e9montrer devant le juge d\u2019appel que la rupture du contrat de travail entre parties ne l\u2019est qu\u2019aux torts et aux griefs exclusifs de son employeur pour exclure toute r\u00e9paration en sa faveur.<\/p>\n\n\n\n<p><em>\u00ab&nbsp;Au contraire, la Cour de c\u00e9ans constatera que l\u2019intim\u00e9 a commis un abus de droit, donc une faute contractuelle en proc\u00e9dant <strong>sans motif valable<\/strong>&nbsp;\u00e0 la rupture des relations contractuelles entre partie. En l\u2019esp\u00e8ce, la concluante n\u2019a cess\u00e9 de fournir \u00e0 l\u2019intim\u00e9 l\u2019emploi convenu (Directeur Juridique) et la r\u00e9mun\u00e9ration pour ses prestations&nbsp;; Ce faisant, la Cour dira abusive la r\u00e9siliation unilat\u00e9rale du contrat de travail par l\u2019intim\u00e9&nbsp;\u00bb<\/em>, ont avanc\u00e9 les avocats de MIDEMA qui ont aussi fait remarquer \u00e0 la Cour que&nbsp;le non fondement de l\u2019action originaire de son employ\u00e9.<\/p>\n\n\n\n<p>Ils arguent en effet que la rupture du contrat de travail est intervenu sans pr\u00e9avis et \u00e0 l\u2019initiative de l\u2019employ\u00e9 seul d\u2019o\u00f9 il ne sera pas tenu compte du temps de pr\u00e9avis dans le calcul du d\u00e9compte final&nbsp;; aussi, la cr\u00e9ance de d\u00e9compte final \u00e9tant soumise \u00e0 la r\u00e8gle que la dette est qu\u00e9rable et non portable, la soci\u00e9t\u00e9 souligne que Jean-Pierre Ntumba Kabesa qui a \u00e9t\u00e9 invit\u00e9 \u00e0 entrer en contact avec ses services comp\u00e9tents, n\u2019a prouv\u00e9 que son employeur aurait refus\u00e9 de lui payer le d\u00e9compte final calcul\u00e9 par elle et mis \u00e0 sa disposition.<\/p>\n\n\n\n<p>De ce qui pr\u00e9c\u00e8de, MIDEMA sollicite de la Cours de c\u00e9ans de retenir que le comportement de l\u2019intim\u00e9 constitue un abus de droit dans l\u2019exercice des actions en justice et m\u00e9rite d\u2019\u00eatre sanctionn\u00e9 d\u00e8s lors que, dans la rupture brusque de ce contrat entre parties, elle a \u00e9t\u00e9 priv\u00e9e des prestations de son employ\u00e9 par une rupture brusque et sans pr\u00e9avis de son contrat. S\u2019appuyant sur l\u2019article 63, alin\u00e9a 3 du Code du Travail, MIDEMA sollicite de la Cour de dire sa demande reconventionnelle recevable et fond\u00e9e, en lui allouant la somme de 500.000
